Terms of Service

1. Agreement

These Terms govern your use of the FlexKia mobile app, flexkia.com, and related services. By using FlexKia, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and accounts

You must be legally able to agree to these Terms and meet the minimum age required in your country. You sign in through Apple, Google, or Microsoft and are responsible for protecting access to that provider account and your device. Information you provide must be accurate, and you may not use another person’s account without permission.

3. Health and safety

FlexKia provides general movement and fitness content, not medical advice, diagnosis, treatment, or emergency services. Consider your abilities and surroundings before beginning. Stop immediately if you experience pain, dizziness, shortness of breath, or other concerning symptoms. Consult a qualified healthcare professional before exercising if you have an injury, health condition, are pregnant, or are unsure whether an activity is appropriate for you. Call local emergency services in an emergency.

4. AI assistant

The assistant uses AI to route requests through a fixed set of FlexKia tools for schedules, preferences, body focus, existing workouts, and activity summaries. It does not create new workouts, and unsupported requests are refused. AI interpretation can still be incomplete or incorrect and must not be treated as medical or professional advice. Review proposed changes before confirming them. You remain responsible for deciding whether to follow a suggestion or perform an activity.

5. Acceptable use

You may use FlexKia only for lawful, personal purposes. You may not:

• Attempt to access another user’s account or non-public systems.
• Interfere with, overload, probe, or bypass security controls.
• Use automated means to scrape or copy the service except where law expressly permits.
• Reverse engineer, redistribute, sell, or commercially exploit FlexKia content or software except where law expressly permits.
• Use the service to violate law or another person’s rights.

6. Ownership and license

FlexKia and its licensors own the app, website, videos, designs, text, trademarks, and other service content. We give you a limited, revocable, non-exclusive, non-transferable license to use the service for personal purposes while you comply with these Terms. You retain rights in messages or feedback you provide, while granting us permission to process them to operate and improve the requested service.

7. Availability and changes

FlexKia is currently provided free of charge. We may modify, suspend, or discontinue features and may update these Terms. We do not promise uninterrupted or error-free availability.

8. Third-party services

Sign-in providers, OpenAI, Resend, hosting providers, content-delivery services, app stores, HealthKit, and Health Connect may apply their own terms and privacy policies. FlexKia is not responsible for a third-party service outside our control. Your use of Apple software is also subject to Apple’s applicable standard end-user license terms when required by the App Store.

9. Account suspension and deletion

You may delete your account in the app or follow the external deletion instructions. We may suspend or end access when reasonably necessary to protect users or the service, comply with law, or address a serious or repeated violation of these Terms. Sections that by their nature should survive termination—including ownership, disclaimers, and limits of liability—will survive.

10. Disclaimers

To the fullest extent permitted by applicable law, FlexKia is provided “as is” and “as available,” without warranties of fitness for a particular purpose, non-infringement, or particular health, fitness, productivity, or other results. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by applicable law, FlexKia and its developer will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or use, arising from the service. Nothing in these Terms excludes liability that cannot legally be excluded.

12. General terms

Applicable law governs these Terms without overriding consumer protections that apply where you live. If a provision is unenforceable, the remaining provisions remain effective. These Terms and the Privacy Policy are the agreement between you and FlexKia about the service. A failure to enforce a provision is not a waiver.
